Man found guilty of rape for removing condom during sex

A man in Switzerland has unprotected sex with a woman who thought he was wearing a condom.

In a case that is the first of its kind, the Criminal Court in Lausanne, Switzerland, determined that having sex without a condom constituted rape if the use of one was expected.

The man who was convicted was given a 12-month suspended sentence.

The man who is French, met the Swiss woman through dating app Tinder.

During their second date in the woman’s home the pair began having sex and the man was wearing a condom. However, he removed the condom without her knowing and she only realised he was not wearing it when they finished.

The court heard that the woman would have refused to have sex the man if she had known he wasn’t wearing a condom.
